Terms of Service

1. Acceptance of Terms
By creating an account, accessing, or using ServiceHQ ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you are using the Service on behalf of a business, you represent that you have authority to bind that business to these Terms.
If you do not agree to these Terms, do not use the Service. We may update these Terms from time to time. Continued use after changes take effect constitutes acceptance.
2. Description of Service
ServiceHQ is a software-as-a-service platform for home services professionals that provides:
- AI-assisted lead response via SMS and email ("Aria")
- A branded public business storefront at a ServiceHQ subdomain
- Job management, CRM, and invoicing tools
- Facebook and Google advertising management (Premium plan)
- Automated email marketing sequences (Premium plan)
- Integration with third-party services including Twilio, Stripe, Google Calendar, and QuickBooks
We reserve the right to modify, suspend, or discontinue features with reasonable notice.
3. Account Registration
You must provide accurate, current, and complete information when creating an account. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. Notify us immediately at support@servicehq.co if you suspect unauthorized access.
You must be at least 18 years old and legally capable of entering a binding contract to use the Service.
4. Subscription Plans & Fees
4.1 Plan Tiers
ServiceHQ offers Capture ($250/month), Grow ($500/month), and Scale ($1,000/month) plans. Plan features are described at servicehq.co/#pricing and may be updated with notice.
4.2 Free Trial
New subscriptions include a 14-day free trial. You will not be charged until the trial ends, and you may cancel at any time during the trial at no cost. There is no setup or onboarding fee.
4.3 Billing & Renewal
Monthly subscriptions are billed in advance on the same day each month. Annual subscriptions are billed in full at the start of the subscription year. All fees are in USD. You authorize us to charge your payment method on file for all applicable fees.
4.4 Cancellation
You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period — you retain access through the period you have paid for. We do not provide prorated refunds for partial months.
4.5 Failed Payments
If a payment fails, we will retry up to three times over seven days. If payment is not resolved, your account will be downgraded to the Free plan and your data will be retained for 90 days.
5. Acceptable Use
You agree not to use the Service to:
- Send unsolicited communications (spam) to any person
- Contact individuals who have opted out of communications
- Violate any applicable law, including the TCPA, CAN-SPAM Act, or GDPR
- Impersonate any person or entity
- Transmit malware, viruses, or malicious code
- Attempt to gain unauthorized access to any system or account
- Resell or white-label the Service without written authorization
- Use the AI agent to make false or misleading representations to customers
- Engage in any activity that violates Facebook's, Google's, or Twilio's terms of service
We reserve the right to suspend or terminate accounts that violate this section without notice.
6. AI-Generated Content
ServiceHQ uses artificial intelligence (Anthropic's Claude) to generate responses to leads on your behalf. You acknowledge that:
- AI-generated responses may occasionally be inaccurate, incomplete, or inappropriate
- You are solely responsible for all communications sent under your account, including AI-generated messages
- You should configure your AI agent accurately and review its behavior periodically
- ServiceHQ does not guarantee that AI-generated content will be error-free or suitable for every situation
- Pricing, availability, and scope information provided to the AI agent is your responsibility to keep current
7. SMS & Email Compliance
By using ServiceHQ's communication features, you represent and warrant that:
- You have obtained all necessary consents from your customers to receive SMS and email communications
- You will honor opt-out requests promptly (STOP for SMS, unsubscribe for email)
- Your use complies with the TCPA, CAN-SPAM Act, and all other applicable laws
- You will not use ServiceHQ to send marketing SMS to consumers who have not expressly opted in
You indemnify and hold ServiceHQ harmless from any claims, fines, or penalties arising from your non-compliance with communication laws.
8. Storefront & Public Pages
Each ServiceHQ account receives a subdomain at yourname.servicehq.co. You are responsible for all content published on your storefront, including service descriptions, photos, license information, and pricing. You represent that all content you publish is accurate and that you hold all necessary rights to any photos or materials uploaded.
ServiceHQ may display "Powered by ServiceHQ" branding on Free plan storefronts. Paid plans may remove this branding.
9. Third-Party Integrations
Connecting third-party services (Stripe, Google Calendar, QuickBooks, Facebook Ads, Google Ads) is subject to those providers' own terms of service. ServiceHQ is not responsible for the actions, availability, or data practices of third-party services. You are responsible for your compliance with each platform's policies, including Meta's Advertising Policies and Google's Advertising Policies.
10. Intellectual Property
ServiceHQ and its technology, design, trademarks, and content are owned by ServiceHQ and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works from the Service.
You retain ownership of all data and content you upload to the Service. You grant ServiceHQ a limited license to use your data solely to provide and improve the Service.
11. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT AI-GENERATED CONTENT WILL BE ACCURATE OR COMPLETE.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SERVICEHQ'S TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM THESE TERMS OR YOUR USE OF THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO SERVICEHQ IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) $100.
IN NO EVENT SHALL SERVICEHQ BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST LEADS, OR BUSINESS INTERRUPTION, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
13. Indemnification
You agree to indemnify, defend, and hold harmless ServiceHQ and its officers, directors, employees, and agents from any claims, damages, liabilities, costs, or expenses (including attorneys' fees) arising from your use of the Service, your violation of these Terms, your content, or your violation of any third party's rights.
14. Termination
Either party may terminate this agreement at any time. We may suspend or terminate your account immediately for violation of these Terms, non-payment, or if required by law. Upon termination, your right to use the Service ceases. Your data will be retained for 90 days, after which it will be deleted.
15. Governing Law & Disputes
These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles. Any dispute arising from these Terms or the Service that cannot be resolved informally shall be resolved through binding arbitration under the AAA Commercial Arbitration Rules. Class action waiver: you agree to resolve disputes only on an individual basis.
